Terms of Service for MalayStory

Welcome to MalayStory! These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "User") and Xfaceline Limited. ("MalayStory", "we", "us," or "our"). These Terms govern your use of the MalayStory mobile applications, websites, and any other related services (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.

1. THE SERVICE

The Service provides a global short-drama streaming platform, offering users a diverse library of short-form video series ("MalayStory Content") and related entertainment features. We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, at any time, with or without notice to you.

2. YOUR ACCOUNT

You are responsible for all activities that occur under your account. You agree to provide and maintain accurate, current, and complete information. You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. USER CONTENT AND CONDUCT

You may be able to submit, post, or display content, such as comments or reviews ("User Content"), on the Service. You are solely responsible for your User Content.

You grant MalayStory a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, and publicly display your User Content.

You agree not to post User Content that is unlawful, defamatory, infringing, harassing, hateful, or otherwise objectionable.MalayStory takes no responsibility and assumes no liability for any User Content posted by you or any third party. We reserve the right, in our sole discretion, to remove or edit User Content without notice.

4. PAYMENTS, SUBSCRIPTIONS, AND VIRTUAL ITEMS

Fees: You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. We may revise the pricing for the goods and services offered through the Service at any time.

Subscriptions: Subscriptions automatically renew at the end of the applicable subscription period, unless you cancel your Subscription before the end of the then-current subscription period. The cancellation will take effect the day after the last day of the current subscription period.

Virtual Items: The Service may include virtual currency, points, or other items ("Virtual Items"). You acquire a limited, personal, revocable, non-transferable license to use Virtual Items and you agree that you do not own them.

NO REFUNDS: YOU ACKNOWLEDGE THAT MalayStory IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS OR SUBSCRIPTION PERIODS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY. ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE.

5. INTELLECTUAL PROPERTY

The Service, including all MalayStory Content, features, and functionality thereof, is the exclusive property of Xfaceline Limited. and its licensors and is protected by international copyright, trademark, and other intellectual property laws.

6. COPYRIGHT POLICY (DMCA)

MalayStory respects the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights of any person. If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to [email protected], with the subject line: "Copyright Infringement" and include in your claim a detailed description of the alleged infringement.

7. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Xfaceline Limited. and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

8. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. XFACELINE LIMITED. DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. IN NO EVENT SHALL XFACELINE LIMITED., ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES WHATSOEVER.

9. DISPUTE RESOLUTION AND GOVERNING LAW

These Terms shall be governed by the laws of Singapore. For any dispute, you agree to first contact us at [email protected] and attempt to resolve the dispute with us informally.

For US Users (Arbitration and Class Action Waiver): ANY DISPUTE ARISING FROM THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

10. GENERAL PROVISIONS

Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
